PRODUCT WARRANTY INFORMATION

 

1. WARRANTY AGAINST DEFECTS

  • a)      Each of the products set out in the table in clause 2 (Product) comes with a Warranty provided by No Blows Pty Ltd ACN 660 156 196 (us, our).

3. WARRANTY SCOPE

  • a)      The original purchaser from us of the Product in Australia has rights under this Warranty.
  • b)      We warrant the Product against defects in materials and workmanship under normal domestic use for the relevant period specified above commencing on the date of purchase.
  • c)       If a Product is returned to us during the Warranty Period, and/or we determine that the Product is defective, subject to clause 4, we will either:
    • i.     replace the Product or any defective parts with a new or refurbished Product or part; or
    • ii.    refund the original purchase price in return for the Product.
  • d)      This Warranty applies in conjunction with our terms of trade, available at noblows.com.au/terms-and-conditions/ To the fullest extent permitted by law we exclude all other guarantees, undertakings and representations express or implied, whether arising by statute or otherwise, which are not given in this Warranty or our terms of trade given at the time of supply.
  • e)      To the fullest extent permitted by law, our aggregate liability under this Warranty shall not exceed the original purchase price paid for the Product.

 

4. EXCLUSIONS FROM WARRANTY

  • a)      This Warranty does not cover damage or defects to the Product due to, or caused by:
    • i.     inappropriate, defective, negligent or incorrect installation of the Product, including installation that is in breach of or inconsistent with local, state or federal laws or standards issued, endorsed or distributed by Standards Australia
    • ii.     installation by an unlicensed or unaccredited installer.
    • iii.   misuse of the Product contrary to written instructions provided by us (which may be provided at the time of purchase or on our website);
    • iv.   use of the Product in a non-domestic context. For the purposes of this warranty ‘Domestic means use for all residential or personal accommodation applications such as private dwellings, hotels, motels and retirement villages ;
    • v.    use in improper temperature or other unsuitable environmental conditions;
    • vi.   normal wear and tear or aging of the Product
    • vii.  improper transportation, storage, repair, operation or maintenance of the Product;
    • viii. use of the Product for purposes other than for which the Product was designed or intended; or
    • ix.   forces beyond our reasonable control, faulty plumbing or electrical wiring in the area surrounding an installed Product, fires, earthquakes, floods or other events of “force majeure,” accident, misuse, abuse, negligence, or modification of, or to any part of the Product.

5. MANDATORY TEXT

  • a)      Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
  • b)      You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage.
  • c)       You are also entitled to have the goods repaired or replaced if the Product fails to be of acceptable quality and the failure does not amount to a major failure.
  • d)      The benefits under this Warranty are in addition to other rights and remedies available to you under law. The disclaimers, exclusions, and limitations of liability under this Warranty will not apply to the extent prohibited by applicable law.

 

6. CLAIM PROCESS

  • a)      To claim under this Warranty or to return a Product to us, you must send us an email at the address above with your contact details, a description of the issue and photos (if relevant).
  • b)      We will acknowledge receipt of the claim and may ask for additional information in relation to ascertaining whether this Warranty is available to you and failure to provide this information may limit your entitlement to this Warranty.
  • c)       We will endeavour to process any claim within 28 days of receipt of all required information and if we agree that you may return a Product, the Product must be shipped to us, together with proof of purchase, either its original packaging or packaging affording an equal degree of protection. Replaced products become our property.
  • d)      You agree to reimburse us on request for the inspection and testing of any returned Product determined by us not to be defective or which falls under one of the warranty exclusions.
  • e)      In all cases, our determination as to whether or not a Product is defective and covered by this Warranty will be final.

 

7.  SHIPPING AND HANDLING

  • a)      All replacement products will be available for collection without charge at the location where the Product was purchased.  We will pay all charges related to shipping and handling for replacement Products provided under this Warranty.
  • b)      You will pay all charges related to shipping and handling:
    • i.     when you return a Product to us in relation to a Warranty claim (whether we agree to that return or not); and
    • ii.    of Products that we return to you after determining they are not defective or otherwise fall outside of this Warranty.
